Auto Repossession Before Bankruptcy

Through bankruptcy a debtor may be able to protect and recover a vehicle that has been repossessed by a lender or creditor. Some courts view the filing of a bankruptcy petition as all that is needed for recovery of such property, while others interpret the Bankruptcy Code to mean that the status quo should remain (that the creditor can retain the property) until “adequate protection” is given that the creditor will eventually be paid for the automobile.
